The Announcement of the State Administration for Market Regulation on Administrative Licensing of Special Equipment (No. 41 of 2021) has put forward new requirements for the administrative licensing reform of special equipment production and filling units (hereinafter referred to as the new licensing requirements), which will be implemented from June 1, 2022. To ensure the smooth transition of administrative licensing for special equipment, the following matters are hereby notified.
1、 Transition between the Implementation of New and Old Production Licenses
1. Application after the implementation of new licensing requirements. Starting from June 1, 2022, all applications, acceptance, and issuance of licenses shall be carried out in accordance with the requirements of the new license. The same unit applying for licenses for different product categories (or different stages) shall submit separate applications to the licensing authorities specified in the new licensing requirements.
2. Production unit license. The special equipment production and filling unit license issued before May 31, 2022 (including May 31, the same below) shall continue to be valid within the original license scope and validity period, and shall be renewed according to the new license requirements before the license expires.
3. License matters that have already been accepted. For license matters that have been accepted before May 31, 2022, the accepting authority shall complete the relevant license work according to the requirements and time limit, and issue certificates for the corresponding new license level projects in the "Correspondence Table for License Projects of New and Old Production Units" (see Annex 1).
4. Unaccepted licensing matters. For license matters that have been submitted before May 31, 2022 but have not been accepted due to non-compliance with the acceptance criteria, if there is a change in the implementing authority of the license, the applying unit shall reapply to the new licensing authority after June 1, 2022.
5. License changes. After June 1, 2022, for license matters that require on-site confirmation such as applying for additional items or changing manufacturing or filling addresses, license certificates shall be issued according to the corresponding new license level projects. For licensing projects previously implemented by the General Administration and implemented by provincial market supervision departments in accordance with new licensing requirements, the applying unit shall submit an application to the provincial market supervision department and, after obtaining the new certificate, request the cancellation of the original certificate or corresponding licensing project to the General Administration. For changes that do not require on-site confirmation, such as the name, residence, and office address of the applying unit, they shall be implemented by the original issuing authority, and the original licensing project, licensing level, and licensing scope shall remain unchanged.
2、 Regarding the self declaration commitment to certificate renewal
6. Allow the requirement to apply for a self declaration commitment to renew the certificate. Production units may apply for a self declaration commitment to renew their license 6 months before its expiration (and not exceeding 12 months). Units that have one of the following situations cannot apply for self declaration commitment to renew certificates: those who have been subject to administrative penalties related to special equipment during this licensing period; The product has experienced a special equipment accident or is currently undergoing investigation and handling of a special equipment accident during this licensing period; If problems are found during supervision and spot checks and are criticized or required to be rectified by the issuing authority; Engaging in behavior of evading manufacturing supervision and inspection or installation supervision and inspection; The production performance within the scope of this license period does not meet the quantity specified in the license; Those who have been reported or complained about and are currently under investigation; The license held is a self declared commitment to renew.
7. Self declaration of commitment to self-assessment requirements for certificate renewal. The unit that declares a commitment to renew the license shall conduct a self-evaluation in accordance with the requirements of the license conditions. Only those who meet the license requirements and make a self commitment can apply. The specific requirements for self-evaluation of license projects implemented by the General Administration can be downloaded from the Special Equipment Administrative Licensing website of the General Administration. Provincial market supervision departments can refer to the formulation of self-evaluation requirements for license projects implemented at their own levels.
3、 Other licensing requirements
8. Boiler manufacturing license. In the implementation of the boiler manufacturing unit license, if the license certificate needs to indicate the specific product scope restrictions, the product scope should be in accordance with the project restriction scope specified in the "Special Equipment Production Unit License Catalog" (hereinafter referred to as the "Catalog") and the "Special Equipment Production and Filling Unit License Rules" (hereinafter referred to as the "Rules"). Among them, boiler components should not exceed the scope of the six components specified in the Catalogue, including the drum and header; The types of products not listed in the Catalogue or Rules are generally not included in the scope of restrictions.
9. Design license for pressure vessels and pressure pipelines. If the manufacturing unit of pressure vessels has the license conditions for pressure vessel rule design or analytical design (SAD) at the same time, and only designs its own pressure vessel products, it can apply for manufacturing additional items or apply together with the manufacturing license. During on-site review, each approver of rule design or analytical design should prepare at least one set of corresponding design documents.
When the appraisal and review institution carries out pressure vessel rule design or analysis design, pressure pipeline design, and pressure vessel manufacturing unit rule design or analysis design review, it shall comprehensively assess the business ability of the corresponding design approval personnel, and conduct on-site or off-site theoretical exams according to actual needs. Design approval personnel shall use the General Administration of Pressure Vessel and Pressure Pipeline Design Approval Personnel Examination Platform uniformly( http://cnse.samr.gov.cn )During the theoretical examination, the appraisal and evaluation institution shall submit the theoretical examination results as an attachment to the evaluation report to the issuing authority.
10. On site manufacturing of ultra large pressure vessels. When a manufacturing unit with manufacturing performance but not yet within the renewal period, or without manufacturing performance, conducts its first on-site production of ultra large pressure vessels, the manufacturing site inspection agency shall confirm that it has the resource conditions for A3 level pressure vessel manufacturing and issue a report. The issuing authority shall annotate "including on-site manufacturing" on the certificate, and retain this annotation on the certificate during renewal.
11. License requirements for filling units. The unified license number for mobile pressure vessel filling is TS9211 * * * -20 * *, and the unified license number for gas cylinder filling is TS4211 * * * -20 * *.
Mobile pressure vessels and gas cylinder filling permits should provide relevant documents in accordance with the requirements of the certification exchange unit in "Injection C-11" and "Injection D-7" of the "Rules" for adding filling media. For adding filling addresses, relevant documents should be provided in accordance with the requirements of the certification unit.
12. Requirements for type testing of pressure pipeline components. Seamless steel pipes, welded steel pipes, non-ferrous metal pipes, ductile iron pipes, metal and metal composite pipes, non-metallic material pipes, seamless fittings, seamless fittings, metal and metal composite fittings, non-metallic fittings, metal valves, non-metallic valves, metal corrugated expansion joints, rotary compensators, non-metallic expansion joints, metal sealing elements, non-metallic sealing elements, anti-corrosion pipeline elements, wellhead equipment and Christmas trees, throttling and well control manifolds, flame arresters, and safety valves, emergency shut-off valves, and bursting disc devices in pressure pipeline components shall undergo type tests in accordance with relevant safety technical specifications and standard requirements. Those that fail the type test and obtain a type test certificate shall not be allowed to leave the factory.
Before the revision of the "Approval Rules for Special Equipment Type Testing Institutions", special equipment inspection and testing institutions that have obtained DGX (steel pipes for pressure pipelines), DYX (seamless fittings), DYX (flame arrester), and DJX (non-metallic pipes and fittings for pressure pipelines) type testing qualifications for non-ferrous metal pipes, ductile iron pipes, metal to metal composite pipes, metal to metal composite fittings, flame arresters, other non-metallic materials pipes and fittings, and other non-metallic valves in pressure pipeline components shall conduct type testing in accordance with relevant safety technical specifications and standards.
13. Type test report and type test certificate. The special equipment type test report and type test certificate shall be uploaded by the type testing institution to the national special equipment type test publicity platform( http://cnse.samr.gov.cn )Make a public announcement.
14. License for imported pressure pipeline components. According to the preliminary pilot situation, starting from June 1, 2022, manufacturing units of imported pressure pipeline pipes (A, B) and pressure pipeline valves (A1, A2, B) shall obtain the "Special Equipment Production License of the People's Republic of China" and pass type tests and manufacturing supervision inspections (or import safety performance supervision inspections) in accordance with relevant safety technical specifications, with a transition period until May 31, 2024.
15. Electromechanical special equipment and its components, as well as safety protection devices. Special mechanical and electrical equipment, as well as elevators, lifting machinery, passenger ropeway components, and safety protection devices, are no longer subject to type test filing. Production units should carry out corresponding production activities according to the scope determined by the type test report and type test certificate.
If a large-scale amusement facility manufacturing license is obtained through product type testing in accordance with the "Rules for Manufacturing License of Mechanical and Electrical Special Equipment (Trial)" (National Quality Inspection Boiler [2003] No. 174), the original manufacturing license is no longer valid. Relevant units shall obtain a new license after appraisal and evaluation in accordance with the requirements of the new license before continuing to engage in corresponding manufacturing activities.
For ultra large lifting machinery type test filing and new product varieties not covered in the unit license, and those that have already passed the type test, the production unit may submit a change application according to the new license requirements, and submit the original license (including the filing certificate) and type test data to the corresponding licensing authority. The licensing authority shall handle the procedures for changing the original license certificate based on the correspondence between the new and old license directories. The certificate for prototype testing registration will be invalidated after June 1, 2023.
16. Operator certificate. The old version of the operator certificate issued before June 1, 2019 is still valid during the validity period, and the new version certificate should be replaced during the re examination. The issuing authority shall refer to the "Corresponding Table for Certificate Replacement of Special Equipment Operators" (see Annex 2) for conversion and issuance of certificates, and no certificates shall be issued for cancelled operation projects.
17. Summarize and upload personnel certification information. In order to facilitate the cross provincial application of certificates for special equipment operators and non-destructive testing personnel nationwide, each provincial market supervision department shall be responsible for timely summarizing and uploading the relevant information of special equipment operators and non-destructive testing personnel who are licensed by local licensing authorities to the General Administration's "Special Equipment Personnel Database", and on the National Special Equipment Publicity Information Query Platform( http://cnse.samr.gov.cn )Synchronized public announcement for public inquiry.
18. Matters that do not require permission. For projects that do not require a license from June 1, 2022 and have already been accepted but have not been issued a certificate, the issuing authority shall terminate the licensing process and inform the applicant that they are no longer included in the scope of the license, remind them to strengthen safety and quality management, and implement the main responsibility of the enterprise.
After the release of this document, the Implementation Opinions of the General Office of the State Administration for Market Regulation on Administrative Licensing of Special Equipment (Market Supervision Special [2019] No. 32) will be simultaneously abolished.
